Possession of marijuana is a misdemeanor in Kentucky. Trafficking in less than 8 ounces is a misdemeanor for a first offense, 0-12 months jail time is possible. A second offense trafficking under 8 ounces is a felony. Trafficking over 8 ounces is also a felony even for a first-time offense. The Federal penalties are much harsher.
