Marijuana Charges

Marijuana is the most commonly used drug in the United States and the world.  It was a well established medicine until it was federally criminalized in 1937.  Today, twenty states have decriminalized marijuana for medical use and two states have decriminalized marijuana for recreational use.  Kentucky is not one of those states.

Possession of marijuana is a misdemeanor in Kentucky.  Trafficking in less than 8 ounces is a misdemeanor for a first offense, 0-12 months jail time is possible.  A second offense trafficking under 8 ounces is a felony. Trafficking over 8 ounces is also a felony even for a first time offense.  The Federal penalties are much harsher.  A person convicted of marijuana possession, even if less than a joint, is not eligible for any form of Federal Student Aid.
